Course Description

This course is an introduction and overview of the legal system, the participants, the courtroom process, and post-conviction process of the court system. It demonstrates the connections among participants and how they relate to each other. Additionally, the course covers the history of the court system and the different types of court at the state and federal levels.

...Juvenile Court Process CJS/220 February 28, 2014 Harvey Smith Juvenile Court Process The juvenile court system was put in place for people that commit crimes or have disciplinary problems that are under the age of eighteen. After the age of eighteen a person must be tried in adult court or depending upon the severity of the crime. Initially juvenile court was put in place as a form of rehabilitation for youth. The Juvenile Court System is managed under the theory of rehabilitation rather than punishment in which acts as parens patriae. (Meyer & Grant, 2003). Parens patriae is when a parent is reluctant or incapable to control a child, the state has the power to step in and act in the child’s and society’s best interest (Meyer & Grant, 2003). Juveniles do not succumb to the same rules as adults when being taken into custody. The juvenile justice system is directed toward protecting a youth’s privacy, protecting the youth from harm, and providing treatment or support services rather than punishment (CJI, ch.14). Once a juvenile is found guilty of a crime they are sent a juvenile detention center opposed to being sent to a jail or prison. I believe the juvenile process should differ from the adult process depending on the crime. At a certain age you are able to think logically and understand right from wrong and if you commit a crime you should be able to understand the severity of it. ...Law Opinion January 19, 2014 CJS/220 The United States is not controlled by a king and Queen, but instead is governed by a president, senate, and the house of legislature. The United States is a democracy (Meyer & Grant, 2003). As a democracy the United States is governed by laws enacted by public officials. Citizens are the ones who vote for the public officials such as the President of the United States and the representatives of each state. Laws are created to protect individuals and their property, and are enforced in the United States throughout every community. The Bill of rights of the United States Constitution describes procedural laws that dictate how laws should be administered. The legislative branch of the government creates, reviews, and vote on laws then place them into effect. Once the laws take effect, they are enforced by the executive branch which is in control of all the law enforcement agencies. The judicial branch determines if the laws passed are valid according to the U.S. Constitution and will act as an arbitrator if needed. According to Meyer & Grant no one branch can govern the U.S citizens alone, that is why the United States needs these branches in order to work effectively. The American Common Law system originated from the medieval English legal practices where judges decided both criminal and civil cases based on their individual cases (Bakken, n.d). ...Week 2 Assignment: Law as a “Living Body” CJS/220 The U.S. Constitution provided the structure and framework for the American rule of law that was based from the structure of England. The U.S. Constitution, which was written and accepted in 1787, has influenced the American legal system giving the American people a structure to live by, law and order. Although all American laws are constitutional, when the Constitution was written in 1787 the American culture was very new and it only catered to the majority and nobody else that was brought to the United States. As time passed the comprehension of the Constitution was changed to integrate minorities like African Americans, women, Asian Americans and others to have the same rights as White Americans. The world has changed dramatically and the U.S. has made history since the creation of the U.S. Constitution having added to it in order for the land of the free actually be the land of the free. The term “laws on the books” refers to the actual written laws passed through legislation being by state or federal and recorded in the codified law books. “Law in action” refers to how the law is actually interpreted, carried out, and applied in the courts. As far as it being fair in the justice system, well it has its pros and cons. It’s not fair when a person is singled out by police because he looks different or out of place. ...Assignment: Final Project: Appeals Process Paper Tony Thomas CJS/220 Jerri Mauldin August 21, 2011 An appeal is when a person who is convicted of a crime or is told they can’t do a certain thing and the person submits questions in writing why this decision was made and wants the verdict and the case to be looked at another time. Most causes for an appeal is from people thinking they are innocent or have the right to do what they want where they want to do it. The way an appeals process can affect the overall criminal procedures or process is if the appeal gets looked at and the ruling from the previous judgment gets overturned. The reason the system is affected is it can set an innocent man free or let whoever continue on doing what they want to do. If someone is put in jail or prison for a crime they didn’t commit and they send up an appeal and it gets the ruling reversed it can mean that the case would be reopened because the person who actually committed the crime is still on the loose. It also interrupts the process of the system because everything that has been put in writing saying that this person was guilty has now got to be withdrawn from record. It also means that the person who is behind bars goes free. A good way to improve the appeals process is not letting them sit so long before being looked at. Courts are in place to get the facts and deciding the best course to take in each situation. An appeal is a proceeding where a case that was previously tried in a lower court system. A petition is entered to a higher court to review the lower court’s decision and to see if the legal procedures were correctly followed. (Meyer & Grant, 2003). The appeal process is time consuming and very lengthy. The appeal process request that the high court over turns the lower court’s ruling and they have to take all the information into consideration and make sure that every aspect of the previous trial was don’t legally. The appeal process normally happens when the defense or the prosecution is not happy with the lower courts verdict and sentencing. Since an appeal is not a new trial but a different way for the defendant to have evidence and material heard that might change the verdict.
