Module1 Case Study: Gelato EEO and HRM

2013

Professor:

INTRODUCTION Companies operating in the United States need to be in compliant with Equal Employment Opportunity Commission (EEOC) regulations. There are many laws that are governed by EEOC regulations but in this paper, I will review Title VII of the Civil Rights Act of 1964 and the Age Discrimination in Employment Act (ADEA). I will apply these two laws to the Gelato company hiring practice operating out of Heartland Corners, U.S.A. With the data I have, I will evaluate if Gelato is in compliant with the Title VII of the Civil Rights Act of 1964 for hiring black and other minority groups in the local area. I will also explore their practices of hiring younger employees to determine if they are violation of the ADEA. Lastly, I will make recommendations for compliance with the Title VII of the Civil Rights Act of 1964 and ADEA if any or needed.
THE ISSUE WITH GELATO Gelato is a larger cheese maker that distributes throughout the United States. Gelato is located in Heartland Corners, U.S.A. and employs approximately 200 hundred workers. Currently their employees’ racial make-up is 85 percent white and 15 percent other races. The population of Heartland Corners is 50 percent white and 25 percent African American with the other 25 percent mixed with Hispanic, Asians and other races. The question here is whether or not Gelato is violating Title VII of the Civil Rights Act of 1964 by not hiring at the 4/5th or 80 percent rules used in determining if there is adverse impact on minority groups such as blacks, women, or elderly. The 80 percent rules was originally developed in California but adopted in the 1978 Uniform Guidelines on Employee Selection Procedures, a document used by the U.S. Equal Employment Opportunity…...

...need for effective Human Resource Management (HRM). Human Resource Management is a function performed in organizations that facilitates the most effective use of people to achieve organizational and individual goals (Ivancevich, 2010). As society and organizations grow and become more complex, HRM functions continue to expand into many areas vital to organizational growth and success. The journey to understanding and applying human resource functions covers Equal Employment Opportunity (EEO) and Affirmative Action, Human Resource Planning, Recruitment, Selection, Human Resource Development, Compensation and Benefits, Safety and Health, and Employee Labor and Relations. By exploring each area, we can understand how these functions can be applied to personal career goals and set the stage for a successful future. One important function of Human Resource Management is the understanding and developing policies for Equal Employment Opportunity (EEO). Equal Employment Opportunity has implications for almost every activity in HRM: hiring, recruiting, training, terminating, compensating, evaluating, planning, disciplining, and collective bargaining (Ivancevich, 2010, p. 65). With that in mind, it is vital for all levels of leadership and management in an organization to be involved in EEO policies and programs. Developing policies and programs for each area ensures the organization is complying with the law. More importantly, developing EEO policies and programs prevents......

Mgt 499 Case 1

...Is Wal-Mart's stated vision aligned with the needs of their stakeholders? Melissa Stacy MGT 499 MOD 1 Wal-Mart, the world largest and most successful corporation, also has the unflattering reputation of being so uncaring that it now symbolizes corporate social irresponsibility in the eyes of many Americans. Wal-Mart's problems with its own employees are not just perceptual but fundamentally due to the company's targeting and positioning choice: the delivery of always low prices to customers has meant that such stakeholder groups as employees have had to be squeezed. How did a company heralded as a hero as recently as in 2000 become a corporate monster only a few years later? The company's current predicament was not only foreseeable, but a logical consequence of its strategic choices, through its unbalanced approach to stakeholder commitment. Wal-Mart views its shareholders, consumers, and the community as their most important group of stakeholders, while employees are its second most important one. Wal-Mart has recently begun focusing on providing an explanation related for the company's poor performance with its self-declared second most important stakeholder group: its employees. Wal-Mart is being sued for what some workers say is widespread bad practice in forcing workers to do extra work "off the clock"- unpaid. Wal-Mart's policies forbid the practice, but managers under intense pressure to cut costs have allegedly resorted to it in......

Hsa 515 Assignment 1

...Running head: LAW AND HEALTH CARE SYSTEM ADMINISTRATION Assignment #1 Jennifer Smith HSA 515 Dr. Mezu October 27, 2013 Justify your position about the importance of the physician-patient and hospital-patient relationships. The doctor–patient relationship has been and remains a keystone of care: the medium in which data are gathered, diagnoses and plans are made, compliance is accomplished, and healing, patient activation, and support are provided. To managed care organizations, its importance rests also on market savvy: satisfaction with the doctor–patient relationship is a critical factor in people's decisions to join and stay with a specific organization. A patient must have confidence in the competence of their physician and must feel that they can confide in him or her. For most physicians, the establishment of good rapport with a patient is important (Lipkin 2012). Some medical specialties, such as psychiatry and family medicine, emphasize the physician-patient relationship more than others, such as pathology or radiology. The quality of the patient-physician relationship is important to both parties. The better the relationship in terms of mutual respect, knowledge, trust, shared values and perspectives about disease and life, and time available, the better will be the amount and quality of information about the patient's disease transferred in both directions, enhancing accuracy of diagnosis and increasing the patient's knowledge about the......

...University Dr. Pavone Dr. Pavone Module 1, Case MGT 401 Module 1, Case MGT 401 08 Fall 08 Fall Trident University MGT 401 Module 1, Case Dr. Pavone Based on the background reading and my analysis of the leadership styles of Steve Jobs and Tim Cook I would definitely prefer reporting to Mr. Cook. The reason this is, is because I am a laid back person and have a personality more like Mr. Cook’s so that’s who I would prefer to report too. It just seems I would like Tim Cook’s personality more. He seems a lot more humble than Steve Jobs ever was. In one of the articles for the required readings for this module “Mapping a path out of Steve Jobs shadow” the article states the company is happier and even somewhat more transparent than it was during Job’s tenure. There are fewer frantic calls at midnight, and there’s less implicit pressure on engineers to cut short or cancel vacations in the heat of product development cycles. This alone, states the differences in how the work environment was run under Job’s reign versus Cook’s current time as CEO. The article further states that unlike Job’s, Tim Cook is the type of manager that would wait until the end of meetings so other can give him information to process. His leadership style is quite different both internally and externally. He’s much more open. They think he believes he doesn’t have all the answers so he’s willing to listen to other people. I’m not so sure this was the case with Steve Jobs. We......

...HRM Incident 1 (A Matter of Priorities) MGT 331 (Management of Human Resources) March 23, 2014 Professor J. Barnes Background Sheila Stephens, a production manager for Thompson Manufacturing was put in an unfortunate situation while attempting to juggle a busy work schedule and interview a potential candidate. The human resource manager caught her off guard and insisted she give some attention to an individual he felt would be an asset to the company. Stephens juggled competing interruptions during the course of the interview including phones calls and having to leave the room. The constant interruptions could make the applicant think that his potential manager is not up to task. Current Challenges Whenever a manager conducts an interview, there are always challenges. The key to a successful interview is to be time conscious. The interview should be performed with the least amount of interruptions as possible. The resume of the candidate should have already been reviewed. Also, the inquiry should be structured to include information relevant only to the qualifications of the candidate for the position. An interview is not just an assessment of the individual looking for a position but also an assessment of the organization by the individual. Having a smooth-flowing interview is important as it allows continuous exchange of ideas and conversation (2014, para. 1). Analysis of Issues Stephens was definitely too busy to accommodate an interview on that particular......

Trident Mgt 501 Case 1

...Trident University Module 1 Case Assignment MGT501 Management and Organizational Behavior In this case study I will analyze Ms. Myers journey to a different culture than she was used to how it went wrong and what she might have done better to try and better prepare herself for the journey that she thought she could handle. I’ll analyze the problem using Hofstede’s five dimensions of culture to compare Korean and American assumptions. I will also make recommendations to her management style that might have helped accommodate the Korean environment. Linda Myers journey started out with good intentions and she felt she had a good idea of what she was getting herself into since she had been consulting for Asian firms and thought that she understood the culture well enough to fit in. Her problem was also compounded by the fact that she would be a woman trying to trail blaze into a field and culture dominated by men. It definitely did not help that she didn’t speak the language and from the reading doesn’t appear to have tried to really learn it instead relying on her associates to speak to her in English or having to use an interpreter. She came into the job with big ambitions and plans to change her Korean associate’s way of doing business not understanding that they didn’t want to change. Now let’s look at Hofstede’s five dimensions of culture to compare Korean and American assumptions. First, Power Distance (P/D) According to Mind Tools: This refers to the degree......

...Trident university international | Module 2 Case Assignment | Conflict Management | | Jessica Cupo | 6/11/2012 | | Introduction Conflict occurs regularly within the military organizational structure on the interpersonal, intergroup, inter-organizational, and international levels. A relevant example of interpersonal conflict and resolution recently presented itself between a peer and me in my current role as Awards and Decorations Officer in Charge. A combination of personality, values, communication, and previous interaction bias resulted in the escalation of an interpersonal conflict which required attention in order to regain productivity in the program. As a leader or a team member, a misstep in an interpersonal conflict results in loss of productivity, escalation of bias, and misinterpretation of intentions. Learning from previous conflicts helps to establish de-escalation techniques and facilitate better work-group dynamics. Scenario As the office in charge of a program within my squadron, a conflict recently developed between myself and a peer assigned to my shop for tasking and assigning office duties. The other Captain had recently been removed from his primary job for failing to meet the standards and expectations required. The other Captain and I were commissioned from the same University in the same year group and therefore equals in rank.
